Defendant was accused by a County Attorney's Information, filed July 14, 1956, of the crime of Operating a Motor Vehicle While Intoxicated, as defined in Section 321.281 of the 1954 Code of Iowa, I. C.A., upon the public highways of Shelby County, Iowa. Upon defendant's plea of Not Guilty, trial was had to a jury, which returned a verdict that defendant was guilty as charged.
