Haskell Davidson and Harold H. Cummings, the owners, contracted with S.S. Jacobs Company, a corporation, for the construction of a building. The contractor inadvertently misplaced the building on the lot by approximately twenty-five feet and, as a result of this error, voluntarily agreed to pay the owners $21,400, which settled all existing claims between them except the installation cost of a sump pump in connection with the discharge of sewage...
