THOMPSON, Justice.

About 2:30 a. m. on February 5, 1956, the defendant was arrested while driving his automobile upon the streets of Charles City. The arrest was made by police officers John Gordon, James Johnson and Ralph Milhan. The defendant was taken to the police station.
