The defendant was found guilty of common assault, and his punishment fixed at a fine of $100 and thirty days in jail. He has appealed to this court.

The charge by information grew out of events which occurred on the night of August 31, 1955, in the City of Bonne Terre, St. Francois County, Missouri.
