This case comes to this Court on a Clerk's Transcript. Defendant was charged by information with feloniously breaking and entering the Eagle Grove Grocery Store in Waterloo, Iowa, on October 12, 1956 in violation of Section 708.8 of the 1954 Code of Iowa, I.C.A. He pleaded not guilty and upon trial to a jury he was found guilty as charged in the information, and it was the judgment of the Court, rendered on December 10, 1956, that the defendant be imprisoned...
