Defendant was convicted of the crime of grand larceny in the second degree and appeals from the judgment of conviction.

The defendant had been engaged in an accounting and auditing business in the city of Austin since 1947. As a part of this business he prepared Federal and state income tax returns. The normal procedure was for the defendant to prepare the income tax form himself from information supplied by the taxpayer. One of his employees...
