Appellant, hereinafter called defendant, was indicted for unlawfully receiving and possessing a firearm, "to wit, a silencer, which had been made in violation of Section 5821, Title 26 USC; said possession being a violation of Section 5851, Title 26 U.S.C." Defendant was convicted and sentenced to three years imprisonment in the penitentiary and to pay a fine of $2,000.
