In an indictment returned by the Grand Jury of Los Angeles County, defendant was accused of violating section 11500 of the Health and Safety Code in that he did sell, furnish and give away a preparation of heroin. A plea of not guilty was entered and a jury found defendant guilty as charged. His motion for a new trial was denied and he was sentenced to state prison.
