I have before me now the defendant's motion to dismiss the complaint for "failure to state a claim upon which relief can be granted," Fed.Rules Civ.Proc. Rule 12(b) (6), 28 U.S.C.A. The plaintiff instituted this action praying that the defendant, Brandeis University, be enjoined from withholding a scholarship award and from refusal to permit the plaintiff to renew his registration at the school, or in the alternative, for money damages.
