This is an appeal from an order of the trial court vacating and setting aside a dismissal of plaintiff's cause of action and declaring void a release signed by plaintiff.

Joseph Lang, an employee of Acme Transfer Company, was injured on May 31, 1955, when he was struck by a ladder which fell from the roof of a building adjacent to an alley where he was making a delivery. The ladder belonged to William Bros Boiler and Manufacturing Company...
