Appellant was found guilty of an assault with intent to rape and his punishment was fixed by the jury at one year in the county jail and $500 fine. He has appealed from the ensuing judgment.

There is no challenge of the sufficiency of the evidence and for that reason we do not need to set it out in detail. It is sufficient to state that the prosecuting witness testified that at the time of the trial she was thirteen years of age, and...
