"This action was instituted in January, 1955, by the Trustee in Bankruptcy of Appliances, Inc., against the Defendant for an accounting by the Defendant for all assets of the bankrupt corporation taken by the Defendant during May of 1954, on the grounds that the acts of the Defendant set out in the Complaint constituted a preference of creditors...
