This case comes before us on two appeals from orders of Judge Herlands made in an action, based upon diverse citizenship, asserting a claim of the plaintiff in contract against the defendant, his stockbroker. The action was filed on March 18 in the District Court for the Southern District of New York and on March 19, 1957, service of the complaint was made on the defendant.
