Defendant has appealed from a sentence of life imprisonment for the crime of murder in the first degree. The case arose out of a riot at the State Penitentiary on the night of September 22, 1954, following which defendant and six other inmates were indicted for the murder of a fellow inmate, Walter Lee Donnell. See State v. Laster, Mo.Sup., 293 S.W.2d 300, and State v. Vidauri, Mo.Sup.,
