Petitioner filed his petition for a writ of habeas corpus on May 6, 1957. He alleged that his imprisonment is by virtue of a sentence of December 3, 1956, in the superior court whose judgment provided as follows:

"It is therefore ordered, adjudged and decreed that the said defendant be punished by imprisonment in the County Jail of the County of Los Angeles for the term of one year with good time allowed if earned which sentence is ordered to run...
