This prosecution for a violation of the provisions of Section 2, Title 36, Code 1940, originated in the Justice of the Peace Court on an affidavit and warrant. The charge in the affidavit was that the defendant did operate a motor vehicle upon a public highway while under the influence of intoxicating liquors or narcotic drugs. The affidavit further averred that "James Bradford claims that Josephus Patton also ran over him while riding his motorcycle...
