This is a matrimonial action. Defendant served a note of issue and noticed the action for the February, 1957 Term of this court. Plaintiff now moves for an order "striking the above entitled action from the Special Term Calendar of this Court" invoking the Special Rule of the Appellate Division, Second Judicial Department, for all counties therein to take effect January 15, 1957:
