POWELL, Judge.

Randolph Johnson and Richard Wilson were jointly charged by information filed in the district court of Tulsa County with grand larceny, were tried before a jury and convicted but the jury being unable to agree upon the amount of punishment, left that to the court, who ordered and adjudged that Randolph Johnson be imprisoned in the State Penitentiary at McAlester at hard labor for the period of eighteen months...
