THOMPSON, Justice.

The defendant, having been indicted for the crime of larceny of property of the value of more than $20 and as an habitual criminal, was convicted upon jury trial. Judgment was rendered on the verdict and defendant was sentenced to confinement in the state penitentiary for a term of forty years. His appeal raises various questions.
