The defendant was found guilty of the murder in the first degree of his wife, Mildred H. Bonomi, without recommendation by the jury that the sentence of death be not imposed. G.L. (Ter. Ed.) c. 265, § 2, as appearing in St. 1951, c. 203, and as amended by St. 1955, c. 770, § 78. Sentence of death has been imposed and execution of sentence stayed as required by G.L. (Ter.
