COMPTON, Justice.

Appellant, Max L. Maestas, was found guilty of murder in the second degree for the killing of Cipriano Trujillo January 29, 1955. At the time of the killing, appellant, his wife, and his brother, Felipe Maestas, were at the home of Felipe's estranged wife, Ramoncita Maestas. Felipe either asked or ordered the deceased to leave the house. A struggle between the deceased and Felipe ensued inside the house after the other parties had gone outside. Apparently...
