Plaintiff, a young man 32 years of age, was employed early in January 1954 as a real estate salesman on a straight commission basis by Fox, Incorporated. Defendant Lenore Mitchell was the secretary and treasurer of Fox, Incorporated, and had charge of closing real estate transactions.
