PER CURIAM.

This case is here on a Clerk's transcript. Defendant was indicted, tried and convicted of operating a motor vehicle while intoxicated—third offense (Section 321.281, Code 1954, I.C.A.). From judgment of not to exceed three years in the State Penitentiary, entered thereon, he appeals.

Finding no error in the record the judgment is affirmed.
