This case was heard below on the pleadings. The plaintiff, Raymond W. McLaughlin, of Lunenburg, Vermont, brought an action of tort against the defendant, Elwin N. Blake, of Lyndon, Vermont, for negligence in the operation of a motor vehicle. The complaint alleges that due to the defendant's negligence the plaintiff was injured in an automobile accident occurring on December 18, 1952, at a point in southern Quebec, Canada.
