BELIVEAU, Justice.

On exception. At the close of the plaintiff's case, the defendant's motion for a nonsuit was granted. Exception was taken.

The plaintiff's action is to recover damages suffered by him when struck by an automobile operated by the defendant.

The uncontradicted evidence shows that on the morning of January 8, 1956, about 6:30, the plaintiff coming from his work at the Maine Central Railroad, was walking southerly on the westerly side...
