Appellee brought this action in the form of suit in trespass to try title. The court granted appellee's motion for instructed verdict and defendants Arthur Scruggs and wife, Alvilda, perfected their appeal to the Galveston Court of Civil Appeals and the cause is here on transfer order of our Supreme Court.
