Appellant, together with his brother, Walter Cowherd, and two other men, were charged in an affidavit in the Criminal Court of Marion County with burglary under § 10-702a, Burns' 1956 Repl. They were tried before a special judge and sentenced to the Indiana State Prison for a period of not less than five nor more than ten years.

The only error assigned and relied upon for reversal is the overruling of appellant's motion for new trial. Said motion...
