Plaintiffs, real estate brokers, have appealed from an adverse judgment in their action for commissions alleged to have been earned by them. Plaintiff Jacobs was employed by defendant. In numerous conversations had between them over a period of months, defendant agreed that he would pay the usual commission if Jacobs secured a satisfactory lessee of a building which defendant proposed to build on land owned by him.
