Defendant was accused of having violated Health and Safety Code, section 11500, a felony, in that on or about June 7, 1956, in the county of Riverside, he did wilfully and unlawfully have in his possession a narcotic commonly known as marijuana. It was further alleged in the information that on or about April 28, 1953, he had been found guilty of a violation of the said section of the Health and Safety Code.
