In this suit A. A. A. Realty Company sought damages from the petitioner, Neece, for breach of an exclusive listing agreement. Summary judgment was granted in favor of the petitioner and upon appeal the Court of Civil Appeals reversed and remanded for trial. 292 S.W.2d 811, 813.
