This case was tried by the court without a jury. It is an action for personal injuries brought by the three plaintiffs who were guest passengers in the automobile of defendant. The plaintiff Billy Flanell is the mother of the defendant and the other plaintiffs are friends of both. All of the parties to the action were on a trip from New York City to Miami, Florida. An accident took place on May 2, 1954,
