This controversy involves a strip of land 200 feet wide (railroad right of way) lying within a proven oil field in Converse County, Wyoming.

For the sake of brevity I will refer to the Continental Oil Company, a corporation, as "Continental", the Chicago and North Western Railway Company, a corporation, as "Railway Company" and Elliott Construction Company, Inc., a corporation, as "Elliott".
