By indictment defendant was accused of burglary. In a jury trial he was convicted. He appeals from the judgment and the order denying his motion for a new trial.

On June 2, 1955, about 6 p.m., the owner of the Campus Camera Shop, on Broxton Avenue in Westwood Village, closed and locked the shop. The next morning about 9 o'clock, when he returned to the shop he noticed that the back door had been broken and was open, that a lot of merchandise...
