The defendant in this case was indicated in Harris County. The indictment alleges that he did with force and arms unlawfully, feloniously, and with malice aforethought kill and murder Madie Mullins (his wife) by striking her with an axe. He was convicted of that offense, sentenced to be electrocuted, and his motion for a new trial was denied. Held:
