Plaintiffs in error, Oscar Lair, Gordon Bryant, and C.B. Horton, and one Bill Turner, were charged in the Court of Common Pleas of Oklahoma county, by information with the offense of unlawful assembly, 21 O.S. 1951 § 1314. Turner was granted a severance and only Lair, Bryant, and Horton were tried. They were tried by a jury, convicted, but the jury was unable to agree on the punishment and left...
