Three defendants, appellant, Adolph Edward Bigarani, and Frank Mendes, were charged with conspiracy to violate Penal Code, section 496 (receiving stolen property), and by separate indictment were charged with receiving stolen property. At the trial of all three defendants, the jury disagreed. Appellant then moved for separate trial, the motion was granted, and, with consent of the district attorney, the indictments were dismissed as to Bigarani and Mendes...
