The indictment charges that on 20 August 1956 the defendant committed the crime of sodomy. The indictment was filed on 27 February 1957. At the time of arraignment on 4 March 1957 the defendant moved to quash the indictment "for the reason that the defendant was not indicted by a grand jury legally constituted." The motion was denied.
