NIX, Judge.

The defendant, Gus Dollie, was convicted of the crime of driving a motor vehicle while under the influence of intoxicating liquor, as a felony by virtue of having pleaded guilty to a similar offense in 1952. Defendant was found guilty by a jury and his punishment fixed at two and one-half years in the state penitentiary.
