This is an original proceeding in this court. Petitioner filed his application for the issuance of an alternative writ of prohibition commanding respondent to cease to act in excess of his jurisdiction and to show cause on a day certain why said alternative writ of prohibition should not be made permanent. The alternative writ was issued by this court and respondent duly filed his return to such alternative writ. Written briefs were filed by the parties...
