JOHNSON, Justice.

This is a action growing out of a divorce proceeding. Carl Thomas was plaintiff, and Viola Thomas was defendant. The action was filed in the Pittsburg County District Court February 7, 1955. The case also involved the care and custody of their infant child, Sharon Sue Thomas, who is now four years old.
