Plaintiff in error, John C. Lenihan, hereinafter called the defendant, prosecutes this writ of error to review a judgment of the county court of Lee county. In the county court, defendant was charged with the offense of operating a motor vehicle upon a public highway while under the influence of intoxicating liquor as defined in section 47 of the Uniform Traffic Act.
