The action is in tort for negligence in the use of the defendant's lands. A jury was empanelled to try the issue in the Law Division of the Superior Court; and at the close of the testimony taken on behalf of both parties, there was judgment final for defendant by direction of the judge. The evidence was deemed insufficient to sustain the pleaded common-law liability. The Appellate Division affirmed,
