ASHBURN, J.

Appellant and one Beaudo were charged with burglary and grand theft. Beaudo pleaded guilty to petty theft. Appellant was tried without a jury, found guilty of burglary in the second degree and not guilty of the charge of grand theft. Probation having been denied he appeals from the judgment. He also attempts to appeal from an order denying motion for new trial, but the record reflects no such motion or order...
