On November 3, 1955, Frank Pendleton, hereinafter called claimant, filed his first notice of injury and claim for compensation, stating that on August 22, 1955, while in the employ of the United States Gypsum Company, he sustained an accidental injury arising out of and in the course of his employment when he injured his back.
