This case, an action in trespass to recover for personal injuries, is before the court en banc upon a motion by defendant, Ed Chapman, for a judgment n. o. v., following a verdict in favor of plaintiff for $2,500. The sole question before the court is whether the evidence discloses that plaintiff was guilty of contributory negligence as a matter of law.
