By indictment defendant was accused of violating section 11500 of the Health and Safety Code in that he unlawfully sold heroin. An amendment to the indictment alleged that defendant had been previously convicted (1) of illegally concealing and purchasing narcotics (federal offense), a felony; and (2) violating section 11500 of the Health and Safety Code, a misdemeanor.
