This controversy has its origin in the following undisputed facts: On April 18, 1952, in response to an advertisement by the appellee Myron E. Raker offering real estate for sale at 4635 Old Mill Road, Fort Wayne, Indiana, Arnold Hirschberg telephoned the appellee for an appointment to inspect the property and, with his wife, met the appellee on the premises about 10:30 A.M. of that day.
