This case has resulted from a traffic accident that occurred in the city of Battle Creek about 7:30 o'clock in the evening of January 10, 1953. While crossing a public street in that city, plaintiff's decedent, Claude Ray Goddard, a child 3 years of age, was struck by an automobile driven by defendant, sustaining injuries resulting in death the following day.
