The plaintiff in this cause loaned the defendant, M. Luther Livengood, $10,000 on or about March 18th, 1952. The defendant and his wife, Blanche S. Livengood, met the plaintiff in the office of Harry C. Kinne, Sr., an attorney at law, who was then and there acting for the plaintiff, Gerald Dobie, and at that time the plaintiff delivered to the defendants a draft for $10,000 and at the same time, the defendants...
