James Dukes was indicted by the grand jury of Cook County for the murder of John Blyth, a Chicago police officer. A jury in the criminal court returned a verdict of guilty and fixed his punishment at death. Post-trial motions were overruled and sentence was imposed in accordance with the verdict.
